The Texas Alcoholic Beverage Commission (TABC) requires many applicants to provide a financial guarantee to ensure compliance with certain regulations and payment of state taxes. Applicants may provide a Certificate of Deposit, a Letter of Credit issued by a Texas financial institution, or a bond issued by an insurance company licensed by the State and approved by the Commission.

Conduct Surety Bonds
In Texas, Conduct Surety Bonds are required by the TABC and must be filed in amounts of either $5,000 or $10,000. These bonds are typically easy to obtain and are generally required for all new “On Premises” applicants during the first three years of operation. A waiver of this requirement may be granted if the applicant has applied for and qualifies for a Food and Beverage Certificate, or if the applicant holds a majority interest in another “On Premises” location where the bond requirement has already been met.
A $10,000 bond is required under the following circumstances:
- The applicant is charged with an offense under the Texas Alcoholic Beverage Code and currently does not have a bond in place.
- The applicant’s premises is located within 1,000 feet of a public or private school and is within an “Alcohol Exclusion Zone” as defined by an ordinance passed by a City or County.
Mixed Beverage Permit Bonds
In Texas, a Mixed Beverage Permit bond, Certificate of Deposit, or Letter of Credit is required for all new applicants seeking a Mixed Beverage Permit. While mandated by the Texas Alcoholic Beverage Code, the bond or financial guarantee is filed with the office of the State Comptroller of Public Accounts. This bond or guarantee serves the following purposes:
- It provides a minimum statutory coverage of $7,500 to protect the state against the non-payment of the 14% Gross Receipts Tax on alcoholic beverage sales made by permittees.
- The amount of the bond or financial guarantee can be increased to twice the amount of tax paid within any 30-day period by the permittee.
- It is required for the first two years of operation and will be released once taxes and reports are filed on time.

Sales & Use Permit Bonds
In Texas, all holders of TABC licenses and permits (such as alcoholic beverage retailers) are required to apply for and maintain a Texas Sales and Use Tax Permit, which is issued by the office of the State Comptroller of Public Accounts. This permit must be renewed annually. Failure to keep your Sales and Use Tax Permit in good standing can result in the suspension or cancellation of your TABC Permit. While there is no fee for the Sales and Use Tax Permit itself, maintaining this permit is crucial for keeping your TABC license active and compliant.
